The War on Drugs in Chimayo, New Mexico
and northern New Mexico, USA

It's Now Official -
Official Incompetence Prevails in War on Drugs in New Mexico
(So What Else is New?)

Update March 2002 News & Stories:

Cocaine and heroin continue to run rampant in northern New Mexico - area overdose's and violence continues!

Federal Judge's ruling of "mental incompetence" for area drug lord [Jose Martinez], aka. "Fat Jose," will eventually lead to this drug dealer getting Social Security benefits for mental disability, and possibly no jail time for his felony crimes! A major setback for law enforcement in the War on cocaine and heroin in northern New Mexico. [This is part of the United States folks!]. The Question: What big name New Mexico politico ["patron"] and money power was influential in that decision, and why? That's the question that people all throughout northern New Mexico and other parts of the State are asking themselves. The good and descent people in Chimayo are wondering if the Fed's, the New Mexico Legislature, and the other self-serving politicos, haven't left the people of Chimayo hanging between a rock and the hard spot? Not only have my wife and I been sold out, but so has the entire community and populace of northern New Mexico and Chimayo.

Breaking News: "Fat Jose" lost his bid for Social Security benefits and his "mental incompetence" plea failed!!!!

A Defense Attorney for area drug dealers makes a laughing stock out of the DEA and their entire campaign to clean up the area, which was dubbed "Operation Overdose" by the Fed's!

New Mexico State Legislature taking steps to cut money going to the New Mexico State Police! This situation continues to plague the NMSP and other Law Enforcement agencies nationwide. It's hard to enforce important laws when State Legislatures don't give a damn about protecting the people!!!

Northern New Mexico has a long running problem with un-investigated and un-prosecuted criminal corruption and misconduct, that largely remains unchecked [covered up] and not prosecutable by the State Attorney General's Office, or for that matter, anyone else! This is a decade after decade old problem, that still persists and remains relatively unaddressed and uncontrolled by State and Federal politicians, and their bureaucratic counterparts. [But why should they do anything - they are the problem!] Much of the failure of the War on Drugs in northern New Mexico [and elsewhere in the USA] is the direct result of this "good old boy" mentality of greed and power through corruption.

This is a complex issue with several different parts, so here is one of the articles that makes up this complex story. The rest of the articles are at the section with the New & Updated Material, at The War on Drugs in northern New Mexico Index.

NOTICE: Some misguided individuals on the internet, like John Sabotta and other extremist right-wingers, have MISUSED, and IMPROPERLY TAKEN OUT OF CONTEXT, information from the following article. These misguided individuals, like John Sabotta, have done this in order to intentionally and maliciously slander the author and his family, in an attempt to bolster and enhance their extremist right-wing political positions. Because of this vicious and dirty personal attack on the author and his family, by US right-wing extremists, the article has been completely removed by the author.

Some important things to remember:

"All laws which are repugnant to the Constitution are null and void." Marbury v. Madison, 5 US (2 Cranch) 137, 174, 176, (1803)

"Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them." Miranda v. Arizona, 384 US 436 p. 491

"An unconstitutional act is not law; it confers no rights; it imposes no duties; affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed." Norton v. Shelby County 118 US 425 p. 442

"The general rule is that an unconstitutional statute, though having the form and name of law, is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it's enactment, and not merely from the date of the decision so branding it.

No one is bound to obey an unconstitutional law and no courts are bound to enforce it" 16 Am Jur 2d, Sec 177, late 2d, Sec 256

Supreme Court rulings have been handed down since the beginning of the United States that tell our Judges and Juries that they are freely allowed to have a legal questioning brain on their own, and that making decisions on their own is a power that both Judges and Juries can have, especially when it concerns the law and the constitution.

"The jury has a right to judge both the law as well as the fact in controversy." John Jay, 1st Chief Justice, US Supreme Court, 1789

"The jury has the power to bring a verdict in the teeth of both law and fact." Oliver Wendell Holmes, US Supreme Court Justice, 1902

The case books of Courts from high to low throughout the US, are filled with instance after instance where both Judges and Juries have followed the US Constitution and the circumstances of the case first, and the letter of the law second. Of course those were Judges and Juries filled with a love for the US Constitution, and the courage for doing what is right, despite the opinion of "good old boy" peers.

If we can not count on the Judicial system for anything but being a victim, and if we can not expect immediate and genuine help from the elements of law enforcement [for any reason], then we will invoke the sovereign Law and natural right born out of the necessity to protect oneself and others [family, society] from a dangerous and public menace. Like I said earlier; options, because of what has been stated here, and because of what continues to happen to us, have become few.

Who do you trust and where do you go when the whole system about you, continues to habitually fail you and others around you on a massive scale?

Remember: Everyone on both sides of the hard drug issue is making such massive amounts of money from it, that the philosophy of those making the profits from it, is why disturb the cash cow.

If authorities earnestly need to start placing the blame on why the War on Drugs is such a miserable and costly failure, and why no one wants to cooperate, then the authorities need look no further than themselves, and situations like this one, for the blame.

"The poorest man may, in his cottage, bid defiance to all the forces of the Crown. It may be frail, its roof may shake; the wind may blow through it; the storm may enter; the rain may enter; but the King of England may not enter; all his force dares not cross the threshold of the ruined tenement."
William Pitt - speaking before the House of Common's in the 1600's, in an attempt to secure the protections of LIFE, LIBERTY, and the PURSUIT OF HAPPINESS for the masses of people.

This verifies the fact that the right-wing movement in the United States does not believe in or practice their much bragged about "compassionate conservatism," and that the only thing the right-wing in the United States is compassionate about, is forcing their sick and warped right-wing agenda on the United States, and the rest of the World.
